Article 1: Scope of the General Terms and Conditions of Sale

These general conditions govern the sale of holidays by Camping La Ferme de Castellane. They constitute the entire contractual relationship between the campsite and its customers. All other conditions are excluded, unless modified and accepted by the customer at the time of booking.

The Campsite reserves the right to modify its general terms and conditions at any time. However, the version applicable to the customer is the one accepted at the time of booking.

Article 2: Acceptance of the General Terms and Conditions of Sale

The customer is deemed to accept these General Terms and Conditions of Sale without reservation, in accordance with article 1126 of the French Civil Code. When booking online or by receiving confirmation of the booking by e-mail, the customer expresses their specific, free and informed consent, in particular with regard to the use of personal data. This acceptance is valid for the customer and for all persons taking part in the holiday. The General Terms and Conditions of Sale are also available on the campsite website and at Reception.

Article 3: Booking

3.1 Booking conditions Booking methods :

Customers can book online, by telephone or directly on site.

Validation of the reservation: All reservation requests are considered definitive from the moment they are accepted by the Campsite. The Campsite reserves the right to refuse a booking depending on availability or any other circumstance that may affect the planned stay. Acceptance of a booking is confirmed by sending confirmation by e-mail, post or hand delivery.

To validate a reservation, the customer must make a payment comprising :

  • A deposit of 35 % of the total cost of the stay.

 

The online provision of the customer's bank card number and the final validation of the order constitute proof of the customer's agreement and render payable the sums due in respect of the reservation, as well as all the operations carried out.

Capacity and participants : Reservations are made by name. The customer must be over 18 years of age and be taking part in the holiday booked.

They must also legally provide the number and ages of all participants, including minors and newborns. Any person not registered at the time of booking is requested to report to reception on the day of arrival. Incorrect information may result in cancellation of the holiday. As the booking is made by name, it may not be transferred or sublet, in whole or in part, without the prior express written agreement of the Campsite. For safety and insurance reasons, the maximum number of occupants per type of accommodation/site, as indicated on the website, must be respected. The Campsite will refuse any person exceeding this capacity, with the exception of any visitors invited by the customer for the day.

Groups : The campsite offers family-oriented holidays, with accommodation specially designed for this purpose. The Campsite reserves the right to refuse any booking that does not comply with the reception and accommodation capacities offered. The Campsite considers a group to be any booking of 5 or more rental accommodations/plots, made by the same natural or legal person, or by different natural persons who know each other and are travelling together for the same reasons, on the same dates and at the same Campsite.

Requests for group bookings must be sent by e-mail to accueil@camping-la-ferme.com or by telephone to 04 92 83 67 77 (price of a local call depending on your operator), specifying that the request is for a group booking. The campsite reserves the right to examine the request before accepting or refusing it.

3.2 Important information Reception of minors :

For obvious safety reasons (swimming pool, evacuation of the campsite in the event of an alarm, etc.) and for health reasons (hospitalisation, etc.), minors who are not accompanied by their legal representatives are not admitted, in accordance with article 389 of the French Civil Code. Furthermore, in accordance with decree 2002-883 of 3 May 2002, the campsite is not authorised to accept minors under the age of 18, unaccompanied by one of their legal representatives, outside their family home. Minors accompanied by their legal guardians are entirely responsible for themselves and must under no circumstances be left unsupervised on the campsite premises, including the water park.

Non-contractual nature of communication media: All documents other than these General Terms and Conditions of Sale, such as catalogues, prospectuses, advertisements and notices, are for information purposes only and are not contractually binding. Plans and photos of rental accommodation are provided for illustrative purposes only. The layout and characteristics of the rooms may vary from one model to another. We recommend that you consult the detailed description of the layout available in the "accommodation" section of the campsite website for the exact composition of each rental accommodation. A description is also available inside each rental accommodation. If you have any questions, please contact the campsite on 04 92 83 67 77 (price of a local call depending on your operator).

Campsite facilities and activities: It is possible that certain activities and facilities offered by the Campsite (directly or via service providers), such as wifi or elements mentioned in the description, may be withdrawn or unavailable, particularly for climatic reasons or in cases of force majeure, or that they may not be operational, particularly in the early and late season. The Campsite declines all responsibility in this respect. The Campsite will inform the customer of any works, incidents or improvements in progress during his stay.

Article 4. Prices

The applicable prices are those indicated at the time of booking by telephone, on the internet or on the campsite website. They may change during the season and are in euros, including VAT. Any subsequent change in the applicable VAT rate, occurring between the time the rates were determined and the time the holiday was invoiced, will result in a proportional change in the price including VAT, which the Customer accepts unreservedly.

The price includes :

  • Rental of the pitch or fully-equipped rental accommodation as defined on the website;
  • Water, gas and electricity consumption;
  • Access to hot showers and sanitary facilities;
  • Access to the swimming pool ;
  • Access to the campsite, its facilities and installations;
  • A parking space for one car per rental (not necessarily on the rented pitch).

The price does not include :

  • The various taxes ;
  • Paid activities offered by the campsite, to be paid for on site;
  • Supplements such as cleaning costs ;
  • Guarantee deposits ;
  • Cancellation/interruption insurance ;
  • Optional equipment (etc.).

Article 5. Terms and conditions of payment

5.1 Terms of payment

  • For bookings made more than 30 days before the start of the holiday, a deposit of 35 % of the total cost of the holiday must be paid at the time of booking. The balance must be paid no later than 15 days before the start of the holiday.
  • For all bookings made less than 30 days before the start of the holiday, full payment must be made at the time of booking.

If full payment is not received by the agreed date, the Campsite is entitled to consider that the Customer has cancelled the booking and will retain any sums already paid.

For groups, payment terms are specified at the time of booking.

5.2 Payment methods

The following methods of payment are accepted by the campsite: credit card, cheques, holiday vouchers and cash.

5.3 Details on credit card payments

Credit cards accepted are Carte Bleue (Visa, Eurocard/Mastercard). American Express is not accepted. The transaction is immediately debited from the customer's bank card after verification of their details. In accordance with article L.132-2 of the French Monetary and Financial Code, the payment undertaking given by means of a payment card is irrevocable. By providing their bank card details, either online or by telephone, customers authorise the Campsite to debit their bank card for the amount of the deposit or the total cost of the holiday. To this end, the customer confirms that he/she is the holder of the bank card to be debited and that the name on his/her bank card is indeed his/her own.

Article 6. Services not included in the price

6.1. Tourist tax

The tourist tax is collected on behalf of the municipalities and must be paid at the campsite. The amount, determined per person per day, varies according to the destination and may be changed during the year. This tax only applies to people of legal age.

6.2. Paid activities offered by the Campsite to be paid for on site.

Some activities offered by the Campsite or one of its service providers are optional and subject to a charge. Access to the campsite swimming pool is not a chargeable activity.

6.3. Household expenses

The Customer may request that the departure cleaning be carried out by the Campsite for a fixed cleaning fee, the amount of which varies according to the range of mobile home. The cleaning fee does not include the cleaning of crockery and kitchen utensils, and rubbish bins must be disposed of.

6.7. Optional equipment

The campsite offers optional equipment such as cots, barbecue, baby chair.... These facilities are available on request and subject to availability. Article 7. Withdrawal

The Customer is hereby informed that, pursuant to article L. 121-20-4 of the French Consumer Code, the sale of accommodation services provided on a specific date or at a specific time is not subject to the provisions relating to the withdrawal period applicable to distance selling. No right of withdrawal therefore applies to the sale of holidays by the Campsite. However, this derogation does not apply to any insurance policies taken out (14-day period in accordance with legal provisions).

Article 8. Changes to the booking/stay

All requests for changes must be made at least 10 days before the start of the holiday. It is up to the Customer to make the request to the Campsite by telephone or e-mail to the following address accueil@camping-la-ferme.com. The campsite will do its utmost to accommodate your request, subject to availability and the applicable rates.

If the modification is not possible or accepted, the Customer will have to make his stay under the conditions initially planned or cancel it.

Article 9. Cancellation of stay 

9.1 Cancellation by the Campsite

Except in cases of force majeure, the stay will be refunded in full. Under no circumstances may this cancellation give rise to the payment of damages.

9.2 Total or partial cancellation by the Customer

It is the Customer's responsibility to notify the Campsite by telephone or by e-mail to the following address: accueil@camping-la-ferme.com. The date on which the cancellation is received will determine any cancellation charges. In the absence of written communication in the above-mentioned manner, the Customer will be obliged to pay the full amount due for the reservation.

Article 10. Course of the holiday

10.1 Arrival and departure times

Arrivals are from 4pm and departures before 10am.

In the event that a Customer is unable to respect the arrival times, it is the Customer's responsibility to contact Reception immediately to try to find a solution. In the event of no-shows within 24 hours of the scheduled arrival date and without a written notice sent to the Campsite confirming the date of arrival, the Campsite reserves the right to put the accommodation/pitch up for sale.

No refunds or compensation will be made. No reductions will be made for late arrivals or early departures.

10.2 Check-in / Check-out

Check-in - On arrival, Reception will check the Customer's balance. The Customer must have paid the balance in full and show valid official identification. After registering the Customer's arrival, Reception will give the Customer the keys to the rental accommodation and the regulatory information. It is the Customer's responsibility to check the inventory on arrival and to report any discrepancies within a day of arrival.

Check-out - It is the Customer's responsibility to return their accommodation in a clean and tidy condition. If they fail to do so, they may be charged a cleaning fee. Similarly, any object broken, lost or damaged during the stay may be billed to the Customer.

10.3 Internal regulations

During the stay, the Customer undertakes to comply with the campsite's internal rules, which are available/posted at reception and on the campsite's website. These rules apply to all persons residing with or under the responsibility of the Customer.

Unless otherwise stated in the campsite rules or expressly authorised by the campsite, tents may not be erected on rental accommodation pitches.

In the event of flagrant non-compliance with these rules, the Manager may impose sanctions which may go as far as termination of the contract, especially in the event of disruptive behaviour that is contrary to the calm and serenity of the reception or in the event of violent behaviour, abusive, racist or threatening remarks made against other Customers, Campsite staff or its partners or suppliers. Customers are informed that they may also be refused access to accommodation.

10.4 Animals

Two pets are allowed per rental accommodation or pitch, provided they are notified at the time of booking or on arrival. Pets are not allowed to roam freely and must be kept on a lead, including on the rented pitch. They are not allowed in the pool area, children's play area or toilet blocks. A fee of €3 per day per pet will be charged on arrival. Pet faeces must be collected by the Customer and their behaviour must not disturb the peace and quiet of other customers. Customers are asked not to leave their dogs alone. Two conditions must be met for animals to be accepted: a valid anti-rabies vaccination and identification by tattoo or chip certified by a card issued by the Société Centrale Canine. Customers must bring their animal's health record with them. Dangerous or aggressive animals (including 1st and 2nd category dogs), as well as exotic animals, are not accepted.

10.5 Visitors

Any visitor invited by the Customer must be notified and registered at the Campsite Reception. The Campsite reserves the right to refuse them access to the Campsite's services. Visitors must comply with the Campsite Rules and Regulations.

All visitors aged 7 and over staying more than 2 hours on the campsite must pay a fee. The amount is set according to the current tariff. For less than 2 hours, visitors are admitted free of charge to the site, but without access to the water park. Their vehicle is not allowed inside the campsite and must remain in the communal car park.

Article 11. Liability

Open-air hotels are not covered by the liability of hoteliers under article 1952 of the French Civil Code. Consequently, the Campsite cannot be held liable for the loss, theft or damage of personal belongings, whether in the Campsite, car parks or communal areas (bicycle rooms, toilets, etc.). Parking is at the Customer's own risk. It is the Customer's responsibility to take out civil liability insurance and, if necessary, to contact their usual insurance company to extend their comprehensive home insurance cover to the accommodation occupied for the duration of the stay.

For all stages of access to the Website, the booking process and subsequent services, the Company has only an obligation of means. Although the Campsite makes every effort to maintain an operational service, it cannot offer any guarantee as to the continuity of access to its Website and therefore declines all responsibility for any direct and/or indirect damage caused by the impossibility of accessing it in whole or in part or which may arise from the use of the service by an Internet user. The Campsite may not be held criminally or civilly liable for the consequences resulting from inappropriate or unauthorised use of the Website or its content by users or any other third party.

The Campsite may not be held liable for any false, misleading or erroneous information given in catalogues or on the Websites concerning the Campsite, in particular presentation photographs, descriptions, activities, leisure activities, services and dates of operation, as a result of the communication by any third party of photographs to which they have declared that they have the rights.

The Campsite shall not be held liable for the non-performance or improper performance of the contract entered into, in the event of fault on the part of the Customer, in the event of force majeure or the unforeseeable and insurmountable act of a third party unrelated to the provision of the services provided for in the contract. In any event, should the Campsite be held liable for any reason whatsoever, any compensation shall be limited to the cost of the stay.

Article 12. Complaints

Any complaint must be reported to the Campsite by the Customer during his/her stay so that the Campsite can remedy the non-conformity or establish it. If it has not been possible to remedy the non-conformity on site, the Customer may submit a complaint in writing to the Campsite so that the latter may attempt to remedy the situation. In order to study the complaint as thoroughly as possible, the Customer is asked to provide as soon as possible any factual information (photographs, videos, etc.) that he/she may be able to gather, unless the non-conformity has been noted on site by the Campsite. Any complaint relating to the Customer's stay must be sent by the Customer by post to the address of the Campsite or by e-mail to accueil@camping-la-ferme.com.

No claim will be accepted for an incident that has not been reported to the campsite manager during the stay.

 Article 13. Protection of personal data

13.1 Collection of data

When browsing our website, information is collected about our Customers.

There are 3 categories of information:

  • Information provided by the Customer when making a booking request: surnames, first names and dates of birth of all participants, postal address, e-mail address, telephone number. - Information that we collect automatically: cookies (see policy on the use of cookies).
  • Those we collect from third parties.

The Company considers all this information to be confidential. It is used solely by Camping's internal departments to process the Customer's request and to enhance and personalise the communication and services offered to Customers.

Article 14. Authorisation for image rights

During their stay, the Customer and the persons staying with them (hereinafter the "Guests") may be photographed or filmed within the Campsite as part of group shots (hereinafter the "Images"), which the Customer accepts on their behalf and that of the Guests. The Customer also authorises the Campsite, on his/her behalf and on behalf of the Persons accommodated, to distribute the Images on their social networks for a maximum period of 5 years from the date of acceptance of these General Terms and Conditions of Sale.

In any event, it is understood that the Customer and the Persons accommodated :

- may revoke the above authorisations by notifying the campsite reception in writing during their stay;

- after publication of the Images concerning them on the social networks, may request their deletion by sending an email to the following address  accueil@camping-la-ferme.com

- will not receive any remuneration for the distribution of the Images as provided for in this Article 15.

Article 15. Applicable law, jurisdiction and mediation

These General Terms and Conditions of Sale are governed by French law and any dispute relating to their application shall fall within the jurisdiction of the Courts, irrespective of the Customer's country of origin. In the event of a complaint, and after having referred the matter to the Campsite's Customer Service department in accordance with the Complaints procedure, the Customer may refer the matter to a consumer ombudsman, within a maximum period of one year from the date of the written complaint, by registered letter to the operator.

In application of the provisions of article 1368 of the French Civil Code, it is expressly agreed that the data stored in the information systems of the Company and/or its partners have evidential value. Thus, the data on computer or electronic media stored in this way, if produced as evidence by the Company in any litigation or other proceedings, will be admissible, valid and enforceable between the parties.

Article 16. Partial non-validation of the General Terms and Conditions of Sale

In the event that one of the clauses of these General Terms and Conditions of Sale is rendered null and void by a change in legislation or regulations or by a court ruling, this shall in no way affect the validity of and compliance with these General Terms and Conditions of Sale.
